1. Introduction and Scope of Policy

This Privacy Policy (hereinafter referred to as the "Policy") governs the overarching data practices, procedures, and protocols of DatNova, its parent entities, subsidiaries, affiliates, and authorized operational partners (collectively, "DatNova," "we," "us," or "our") concerning the collection, processing, maintenance, transfer, sale, and disclosure of information obtained from users, authorized representatives, and corporate entities (each, a "User," "you," or "your") accessing the DatNova Enterprise Resource Planning platform, application programming interfaces (APIs), websites, and associated digital properties (collectively, the "Service").

By accessing, registering for, or otherwise utilizing the Service in any capacity, you expressly and irrevocably consent to the data practices delineated in this Policy. This document is constructed in accordance with applicable state, federal, and global data privacy frameworks, including but not limited to the California Consumer Privacy Act (CCPA) as amended by the CPRA, and the Virginia Consumer Data Protection Act (VCDPA).

2. Categorization and Collection of Data

In the course of provisioning, securing, and optimizing the Service, DatNova systematically collects and processes distinct categories of data, defined as follows:

  • Customer Provided Data: Proprietary and commercially sensitive information inputted directly or synchronized by the User, inclusive of, but not limited to, corporate entity details, financial ledgers, transactional metadata, banking coordinates, client repositories, and operational matrices.
  • Automated Usage and Telemetry Data: Information aggregated autonomously via tracking technologies upon your interaction with the Service. This encompasses Internet Protocol (IP) addresses, Media Access Control (MAC) addresses, browser typologies, Internet Service Provider (ISP) routing, cryptographic session identifiers, clickstream heuristics, heat-mapping, and granular feature interaction timestamps.

3. Processing, Utilization, and Predictive Analytics

The data amassed by DatNova is fundamentally utilized to fulfill contractual obligations, provision the Service, and execute our proprietary analytical frameworks. The User acknowledges that the Company utilizes advanced computational algorithms to process data for commercial purposes, including:

  • Algorithmic Business Insights: Facilitating automated financial health grading, continuous cash-runway recalculations, and dynamic dashboard contextualization based on real-time inputs.
  • Macro-Industry Benchmarking: Aggregating data matrices to evaluate Customer performance relative to macro-level, industry-specific operational standards and peer-group percentiles.
  • Ancillary Service Deployment: Utilizing predictive analytics to formulate and deliver highly targeted recommendations pertaining to integrated business solutions, capital deployment opportunities, and third-party commercial partner offerings tailored to the Customer's operational trajectory.

4. Disclosure, Sharing, and Commercial Transfer of Data

DatNova expressly reserves the right to disclose, share, transfer, or commercialize User data under the following paradigms to support our operational and strategic commercial objectives:

  • Service Providers and Affiliates: We may disseminate information to vetted third-party vendors, hosting infrastructure providers, and payment gateways strictly necessary for the execution of the Service.
  • Commercial Partners and Data Brokers: We reserve the right to share, transfer, or sell certain identifiable or pseudonymized data subsets to strategic commercial partners, marketing agencies, capital underwriters, and data aggregators for the purposes of targeted marketing, joint-venture offerings, and expansive predictive modeling. Users subject to specific jurisdictional rights retain the statutory right to opt-out of the commercial "sale" or "sharing" of their personal information by contacting our compliance department at admin@datnova.biz.
  • Corporate Restructuring: In the event of a merger, acquisition, corporate reorganization, bankruptcy, or sale of substantially all of the Company's assets, User data shall be classified as a transferable corporate asset and may be disclosed or transferred to the acquiring entity.

5. Aggregation and Anonymization of Data

Notwithstanding any prior provisions contained herein, DatNova maintains the irrevocable, perpetual, worldwide right to aggregate, obscure, and fully anonymize any data captured through the Service. Once data is reasonably devoid of personally identifiable information (PII) and distinct corporate identifiers, it shall no longer be classified as Customer Data.

DatNova retains sole and exclusive intellectual property rights, title, and interest in all such derived insights, metadata models, algorithmic training datasets, and industry reports, which may be commercialized, published, or disseminated at the Company's sole discretion.

6. Retention, Security Protocols, and No Backup Obligation

The Company implements commercially reasonable, enterprise-grade cryptographic protocols and access controls designed to mitigate unauthorized access to Customer Data. However, DatNova expressly does not function as a data backup, archival, or storage facility. We are solely an analytical processing tool.

Users are solely and exclusively responsible for maintaining independent, redundant copies and backups of all Customer Data. DatNova expressly disclaims any liability for data loss, deletion, or corruption, whether caused by system failure, user error, or cyber-intrusion. We shall retain active data for the duration of the User's account lifecycle, or as otherwise mandated by statutory retention periods.
